The continued trial of the case of Unlawful Acts (PMH) between the plaintiff Bali Marine Service (BMS) Limited Partnership (CV) and the defendant Pelindo Property Indonesia (PPI) Company Benoa, Bali, is increasingly interesting to watch.
The trial was led by Chief Judge Saifudin Zuhri S.H. M.Hum at the Surabaya District Court, Wednesday, (26/2/2025) at 2:30 pm west indonesian time, with the agenda of additional witnesses, the plaintiff presented 3 witnesses at once while showing evidence of alleged acts of intimidation, attempted persecution, and material losses of CV BMS.
CV BMS attorney Heru Suroto and his team said that the presence of 3 additional witnesses with evidence and data provided to the panel of judges further strengthened that what PPI Benoa did was very detrimental to his client.
“The trial agenda this afternoon is to present additional witnesses where we present 3 witnesses, the first witness conveyed the loss of CV BMS, the second witness conveyed the attempted persecution of the Director of CV BMS, Mrs. Fiona, and the third witness conveyed the transfer of CCTV in front of the CV BMS office door, where CCTV was previously installed with a camera towards the office door. With the damage to the key, where there is a broken key, the presumption of innocence, who did it we don’t know, but after the incident, the CCTV was moved with the direction of the camera not towards the focus of the CV BMS office entrance,” said Heru.

When asked how much CV BMS lost materially, which the first witness explained in the lawsuit trial, Heru elaborated specifically.
“The first witness has stated, of the 3 items that make CV BMS lose are related to spare parts, suppliers, and bunkers. From the details and attachments submitted, the loss reached Rp12,850,000,000, – (Twelve billion eight hundred and fifty million rupiah),” he explained.
Heru also explained that the next hearing agenda was the addition of evidence that his party would provide to the panel of judges.
“From the trial process earlier, the next estimated trial is on March 5 with an agenda, namely the addition of evidence that we will submit. Of course this evidence is very supportive because this evidence is valid data that I will submit and attach related to defamation and related to ITE laws, where one of the unscrupulous employees at PPI can still dare to defame my client,” he explained.
Meanwhile, when nasionalxpos.co.id met CV BMS Director Fiona Magdalena Yapsawaky, the Papuan businesswoman said that winning the lawsuit was proof to her client.
“All this time I have been hurt and they have always been arbitrary to me and they think that we will not advance to a lawsuit. My hope is only one, win, that’s all. Why?, because if the court decision says we win, it is enough for me to prove to my client that the money that we have been giving to PPI is indeed for PPI, nothing goes into our account.
